Terms of Service

These Terms of Service ("Terms") govern your access to and use of Kreatorly ("Platform," "we," "us," or "our"), a membership platform based in Nepal that connects creators with fans who support their work, accessible via our website (www.kreatorly.com) and associated mobile applications. By creating an account or using Kreatorly, you ("User," "Creator," or "Fan") agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Eligibility & Account Registration
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account, launch a channel, or purchase memberships. By registering, you confirm that you meet this requirement and that all information you provide is accurate and current. Creators must additionally provide accurate, legal, and verifiable personal or business identity data during onboarding to facilitate payouts and compliance.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at legal@kreatorly.com if you suspect unauthorized access. Kreatorly is not liable for losses arising from your failure to secure your account.
3. Creator Accounts & Content
Creators are solely responsible for the content they upload, including posts, images, audio, and video shared with fans. By uploading content, you confirm that you own or have the necessary rights to that content and grant Kreatorly a limited license to host, store, and deliver it to your subscribers as part of operating the platform.
Kreatorly is a service-first environment for digital artists, writers, podcasters, and filmmakers, and does not claim ownership over creator content. To maintain platform safety, the following is strictly prohibited:
- Sexual content, explicit nudity, pornography, or the performance of sexual acts
- Violence, hate speech, or content violating the prevailing laws of Nepal
- Content that infringes third-party rights, or that the creator does not own or hold a valid license for
We may remove content that violates these Terms, applicable law, or third-party rights, and may suspend creator channels or permanently terminate accounts without prior notice for serious or repeated violations.
4. Memberships & Payments
Fans may subscribe to a creator's membership tiers for a recurring fee. Subscriptions renew automatically each billing period unless canceled before the renewal date.
Platform fee: Kreatorly operates on a commission-based model with no registration fees. We deduct a standard 12% commission on successful fan transactions — subscriptions, one-time payments, voluntary tips, and Creator Store purchases — before transferring payouts, as further detailed on our Pricing page.
Payment gateways: national transactions are processed via eSewa, Khalti, connectIPS, or local debit/credit cards; international payments (including diaspora support) are processed via Stripe or other approved international gateways.
Taxes: payouts to creators are subject to applicable withholding tax (TDS) under the Income Tax Act of Nepal. Creators are individually responsible for declaring and filing income earned through the platform.
5. Cancellations & Refunds
Fans may cancel a subscription at any time; cancellation takes effect at the end of the current billing period unless otherwise stated. All fan subscriptions and voluntary tips are final and non-refundable. If a creator fails to deliver exclusive content, any resulting dispute is between the fan and the creator — Kreatorly is not legally liable for a creator's non-fulfillment.
6. Creator Store & Premium Features
Creators using the Creator Store feature may only sell legal, authentic products (merchandise, tickets, books, and similar goods). Contraband, pirated goods, and unapproved medical items are prohibited.
Kreatorly may display curated advertisements from trusted brands across the platform. Where an ad appears directly on a creator's dedicated page, the creator may be eligible for an ad-revenue split (e.g., 20–30%), subject to platform performance criteria.
7. Prohibited Conduct
You may not use Kreatorly to:
- Upload or distribute unlawful, infringing, defamatory, or fraudulent content
- Circumvent, disable, or interfere with platform security or payment systems
- Harass, threaten, or exploit other users, including minors
- Misrepresent your identity or affiliation with Kreatorly
- Use the platform for money laundering or any illegal financial activity
Violations may result in content removal, account suspension, or termination, at Kreatorly's discretion.
8. Intellectual Property
The Kreatorly name, logo, and platform software are the property of Kreatorly and may not be used without prior written permission. Creators retain rights to their own original content, subject to the limited license described in Section 3.
9. Third-Party Services
Kreatorly integrates third-party services — including payment processors (eSewa, Khalti, connectIPS, Stripe) and Bunny.net for media hosting and streaming — to operate the platform. Your use of these integrated services may also be subject to the applicable third-party terms.
10. Disclaimers
Kreatorly is a technical intermediary connecting fans and creators, provided "as is" and "as available." We do not guarantee uninterrupted or error-free service, uninterrupted video streaming, or any particular level of creator earnings, and we are not responsible for disputes between creators and fans or the quality or legality of creator content.
11. Limitation of Liability & Indemnification
To the fullest extent permitted by law, Kreatorly, its founders, and employees are not liable for indirect, incidental, or consequential damages arising from your use of the platform, including lost revenue, lost data, or service interruptions. You agree to indemnify, defend, and hold harmless Kreatorly, its founders, and employees from any claims, damages, or legal expenses arising out of your content, transactions, or breach of these Terms.
12. Termination
You may close your account at any time from your dashboard settings. Kreatorly may suspend or terminate accounts that violate these Terms, pose a security risk, or engage in fraudulent activity, with or without notice depending on severity.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated through the platform or by email before they take effect. Continued use of Kreatorly after an update constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of Nepal — including the Electronic Transactions Act, 2063 — without regard to conflict of law principles. Any disputes will be resolved exclusively in the courts of Kathmandu, Nepal, unless otherwise required by applicable law.
